Vitamix Australia & New Zealand x Morlife Competition T&C’s

  1. Information on how to enter this Competition and prizes form part of these Conditions of Entry. Promoter is FMHW PTY LTD, ABN 89 601 910 776 of 105 Vanessa Street, Kingsgrove NSW 2208 Australia, and MORLIFE PTY LTD, ABN 66 100 375 666 of 32 Technology Drive, Arundel QLD 4214
  2. Entry nomination is only open to Australian and New Zealand residents who are aged 18 years and older. Employees and the immediate families of the Promoter and its agencies associated with this promotion are ineligible.
  3. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
  4. This Competition runs during the following period: Opening Date 5:00PM AEST 18 July 2022, Closing Date 11:59PM AEST 31 July 2022 (Promotion Period).
  5. This is a game of skill and chance plays no part in determining the winner.  The winner will be notified via the Vitamix AUNZ account from a representative of the Promotor. Judges' decision is final and no correspondence will be entered into. Winner’s name will also be announced on a post on the @morlife Instagram page and the @vitamix_aunz Instagram page.
  6. Conditions of Entry. To enter, entrants must during the Promotion Period for the Draw stipulated in clause 4:
    1. Follow @vitamix_aunz and @morlife on Instagram
    2. Tag a friend and tell us what recipe you would create first with Vitamix and Morlife
    3. For an extra entry, participants can sign up to Vitamix and Morlife e-newsletters via the link in bio.
  7. Each entrant is only entitled to enter once. Entries must be submitted by the individual entrant and any automated entries will be invalid.
  8. Entrants confirm and promise that their entry is their own original work and does not infringe the rights of any other person (including intellectual property rights).
  9. An entry cannot be modified after it has been submitted.
  10. Entry in the Competition is free (excluding internet connection charges).
  11. Entries for the Competition listed in clause 4 must be received by the Closing Date and time specified in clause 4. The time of entry will in each case be the time the entry is received by the Promoter’s database and not the time of transmission by the entrant. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries including delays in the delivery due to technical disruptions, network congestion or for any other reason. The Promoter and its affiliates and contractors accept no responsibility for entries not received by the closing date for any reason whatsoever.
  12. Entries not completed in accordance with these terms and conditions, and any incomplete or indecipherable entries, will be deemed invalid.
  13. All entrants warrant to the Promoter that the above entry requirements have been met.
  14. There will be one (1) winner in total across the Promotion Period.
  15. The total Prize value for this Promotion is $728.95 AUD RRP. Prize inclusions are as follows and are supplied subject to the supply terms and conditions of FMHW PTY LTD.

    a) Winners Prize: 1 x Vitamix E310 valued at $699 AUD & $500 AUD worth of Morlife products (excluding collaboration ranges e.g. Ashy Bines, Steph Pase, Gretty Rose).

  16. The judges will consider each valid entry submitted in accordance with these Terms and Conditions and the winner will be the entrant who submitted the entry judged the most creative and original. The winner will be notified by phone or email using the contact details provided in their entry within 5 business days of the Judging Date as set out in clause 5.  The winner should allow 60 days for delivery of the Prize.
  17. If the winner cannot be contacted within five (5) calendar days of first notification attempt, if the Prize notification is returned as undeliverable, if the winner rejects the prize, or in the event of noncompliance with these Terms and Conditions, their Prize will be forfeited, and an alternative winner may be selected by the judges from all remaining eligible entries using the same criteria. Upon Prize forfeiture, no compensation will be given.
  18. The Promoter accepts no responsibility for any variation in the Prize value.  The Prize or any unused portion of a Prize are not transferable or exchangeable and cannot be taken as cash.
  19. If for any reason this Competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or a affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various government departments, to cancel, terminate, modify or suspend the Competition.
  20. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or trace congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading/up-loading any materials in this Competition.
  21. Any costs associated with accessing the Vitamix Australia & New Zealand social media is the entrant’s responsibility and is dependent on the Internet service provider used.
  22. Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the steps to consumer guarantees under the Competition and Consumer Act 2010 (Cth) of any other implied warranties under the ASIC Act 2001 or similar Consumer Protection laws in the States and Territories of Australia (Non-excludable Guarantees).  Except for any liability that cannot be excluded by law, including the Non-excludable Guarantees, the Promotor (including its respective officers, employees, agents and contractors) excludes all liability (including for negligence) for any personal injury or loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or in relation to this Competition or accepting all or any part of a Prize.
  23. In the event of circumstances outside its control, including war, terrorism, industrial action, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the Competition subject to any written directions from the relevant government departments.
  24. The Promoter shall not be liable for any merchandise that has been lost, stolen, forged, damaged or tampered with in any way.
  25. All entries are deemed to be received at the time of receipt into the promotional database and not at the time of transmission by the entrant.
  26. The Promoter collects entrants’ personal information in order to conduct the Competition. If the information requested is not provided, the entrant may not participate in the Competition. By entering the Competition, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28. The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

In consideration of the entrant’s participation in this Competition, each entrant grants to the Promotor, its affiliates and licensees, a non-exclusive, royalty free, perpetual, worldwide, irrevocable and sublicensable right to reproduce, publish, communicate, modify and adapt the entrant’s entry for any purpose in any media, without compensation, restriction on use, attribution or liability.  Entrants agree not to assert any moral rights in relation to their entries and warrant that they have the full authority to grant these rights.
